Welcome to Brown Bass. These Terms of Service ("Terms") govern your use of the website at brownbass.xyz and the menu photography services we provide (the "Service"). The Service is operated by Dime Box LLC, a Missouri limited liability company ("Brown Bass," "we," "us," or "our"). By ordering, paying for, or otherwise using the Service, you agree to these Terms.
1. What we do
Brown Bass produces photographs of menu items for independent restaurants. A standard order is a set of 8–12 finished dish photos delivered as high-resolution digital files suitable for menus, websites, social media, and third-party delivery platforms.
2. AI disclosure
Our photographs are produced with the assistance of generative AI tools, guided by reference material you provide (menu descriptions, existing photos, plating notes, and similar inputs). The final images are not photographs taken with a camera in your restaurant. We believe the results are honest, appetizing representations of your dishes, but you are responsible for confirming that each delivered image accurately reflects what you serve before publishing it.
3. Your content and inputs
You represent that any menu information, photos, logos, or other material you send us is yours to share, and you grant us a limited license to use it solely to produce your order.
4. Ownership and usage rights
Once your order is paid in full and delivered, you own the delivered images and receive full commercial rights to use, edit, reproduce, and distribute them, in any medium, worldwide, in perpetuity. There are no per-use fees, expiration dates, or platform restrictions. We retain the right to display delivered images in our own portfolio and marketing unless you ask us in writing not to.
5. Payment
The standard menu set is $197 USD, charged in full at the time of order through our payment processor, Stripe. Prices are in U.S. dollars and exclude any taxes that may apply in your jurisdiction.
6. Delivery timeline
We aim to deliver completed orders within 5 business days of receiving your menu information and any required reference material. If we expect a delay, we will email you. Delivery is by download link sent to the email address on your order.
7. Free sample photos
We sometimes send restaurant owners a free sample photo of one of their dishes by email. Sample photos are provided as a courtesy, are not licensed for commercial use, and may be used by us as portfolio examples.
8. Refunds
Refunds are governed by our Refund Policy: 100% refund within 7 days of delivery, no questions asked.
9. Acceptable use
You agree not to use the Service to misrepresent another business's food, to produce images of dishes you do not actually serve, or for any unlawful purpose. We may refuse or cancel any order at our discretion and refund amounts paid.
10. Disclaimers
The Service is provided "as is" and "as available." We do not warrant that delivered images will produce any specific business result, increase in sales, or platform approval. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Limitation of liability
To the fullest extent permitted by law, the total liability of Dime Box LLC for any claim arising out of or related to the Service is limited to the amount you paid us for the order giving rise to the claim. We are not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or lost revenue, even if advised of the possibility.
12. Indemnification
You agree to indemnify and hold harmless Dime Box LLC and its members, employees, and contractors from any claim arising out of your use of delivered images or your breach of these Terms.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Continued use of the Service after changes means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Missouri.
